National Public Radio

This agreement covers programs that are produced for broadcast over national public radio. There are essentially two types of recording under this agreement.

First, this agreement provides for studio scales for those situations where there is a specific call to record music for inclusion in a public radio program. The payment is based on the length of the program and whatever additional rehearsal time that may apply.

The second and more commonly utilized scale is the "concert pick-up" rate. This fee applies when the musicians are performing at a concert (they are also receiving the local's live performance fee) and the event is broadcast and/or taped for broadcast over public radio. The pick-up fee is a set rate and is not based on the length of the broadcast. Again the musicians are receiving along with the pick-up rate the live performance fee established by the local. There are additional fees under the concert pick-up rates if the employer elects to have the initial release in the form of individual pieces (overture, dance, song or a movement of a musical work taken from such recorded performance rather than a release of a complete concert). This type of release is known as segmented broadcasting.

There must be a signatory to the National Public Radio Agreement in place and the applicable wage scales, Pension Fund contribution and Health and Welfare Fund contribution are to be filed on a properly completed AFM B-10 Report Form. For further information please contact Pat Varriale at the New York office of the EMSD with any questions regarding non-symphonic performances or work performed by an orchestra not covered by a collective bargaining agreement. Given the fact there is a heavy volume of recording by symphonic orchestras (CBA orchestras), please contact Debbie Newmark in the AFM Symphonic Services Division - 212 869-1330, ext. 225.
